Terms of Use of SmokingAngel's Text, Images and Video Clips

1. You agree that any legal actions arising as a result of these terms and conditions are to be held in the state of New York and are to be bound by the laws applicable in the state of New York.

2. If any term or condition below is held to be inapplicable by a court of law, all other terms will be in effect to the extent allowable by that court. To the extent possible, any term or condition which is held partially inapplicable in a court of law will be interpreted as closely as possible to the original meaning of that term.

   The term "material" applies to text, images, video clips or any other item to which copyright law applies.

3. By using material from SmokingAngel's site, you implicitly consent to these terms and conditions whether you are aware of them or not.

4. The phrase "clubs, groups and message boards" includes similar concepts such as e-mail, usenet newsgroups, MSN communities, IRC, Yahoo Messenger and any other mechanism which involves interaction between two or more people and which allows files to be transferred or, in the case of textual material, the substantive meaning of that text to be transferred..

5. The phrase "own use" applies to yourself and to people within your household and excludes any transfer of material to anyone who is not normally resident within your household.

6. You must not crop, resize, or compress any images except for your own use.

7. You must not retouch the image to remove or obscure the "SmokingAngel" logo except for your own use.

8. You must take steps to ensure that minors are given adequate warning before they can see an image which has adult content. This applies even to usage within your own household.

9. You must ensure that images which have adult content do not appear on servers in countries where such material would be illegal or offensive.

10. You must not use any image on a pay site without first obtaining written permission to do so. SmokingAngel's decision on what constitutes a pay site is final and is not subject to legal dispute.

    As a general guideline, intended to allow you to determine the likelihood of an application succeeding, free web sites which are sponsored by the ISP's advertisers do not count as pay sites unless you receieve monies or other considerations (apart from the web space itself) as a result of those adverts being present or clicked upon. However, you must apply for written permission from SmokingAngel even for this type of site so that she can confirm that it does not meet her interpretation of a "pay site."

11. If, for any reason, SmokingAngel requests that you remove material that you have copied from her site, you must do so as soon as is practicable. If you do not do so within a reasonable period of time, SmokingAngel reserves the right to to contact your ISP to inform them that you have breached her copyright and request that they take whatever action they deem appropriate in the circumstances. If your ISP takes no action, or takes action that SmokingAngel deems inappropriate, SmokingAngel reserves the right to institute legal proceedings against you.

12. By using or posting material which is copyright SmokingAngel, you implicitly:
    1. Assume full legal and moral liability for that usage.
    2. Agree to fully indemnify SmokingAngel and her associates against the costs of any legal actions which may arise against them as a consequence of that usage.

13. If material from other producers appear on your site and their material is associated with their banner on any of your pages, you must include one of SmokingAngel's banners with a similar prominence and relationship unless you obtain written permission from SmokingAngel to use her material witbout a banner.

    As a general guideline, such applications will not succeed except in exceptional circumstances.

14. If you post material to a club, group or message board where it is not feasible to include a banner then you must associate with the image, or the page the image appears on, a link (or plain text if a link is not possible) to www.smokingangel.net.

15. If you use material which is copyright SmokingAngel on a website, and it is technically feasible to add a banner, you must associate a banner unless you obtain written permission from SmokingAngel to use that image without a banner.

    As a general guideline, intended to allow you to determine the likelihood of an application succeeding, a site where images or pages are accompanied with links or text indicating that some or all images came from www.smokingangel.net are more likely to succeed than those which do not. In general, sites which acknowledge SmokingAngel's explicit permission to omit a banner are more likely to succeed than those which don't. However, in all cases, you must apply for written permission from SmokingAngel to use material without a banner and her ruling is final.

16. You must not pass off any material which is copyright SmokingAngel as your own work.
17. You must not link to material wbich is copyright SmokingAngel without explicit written permission unless the link is from a short-lived, or relatively infrequently-accessed over long time periods, item such as a post to a club, group or message board. Even in such cases, you must not link to any material which is not textual in nature if mechanisms exist which would allow you to copy that material rather than link to it.
18. SmokingAngel takes responsibility for using material from external sources subject to the terms and conditions of use of those sources. If you wish to use such material, you must determine the terms and conditions of use of that material yourself and not rely on SmokingAngel's interpretations of those terms and conditions. In particular, if you copy an example used by SmokingAngel which later turns out to be in breach of the terms and conditions of its use then you must take full legal responsibity for so doing.
19. SmokingAngel does not grant permission for any usage of material which is not her copyright. The original authors must be contacted to obtain permission to use their material.
20. You should, if possible, retain the original filename (this is not possible with Yahoo clubs and groups). This condition is here out of consideration to your fellow fetishists who may otherwise waste time downloading images they already have. Do unto others as you would have them do unto you and the world will be a much happier place.
